Premises Liability

Have you been injured while visiting or living on someone else's property? If the owner is legally responsible, or liable, you may have a premises liability claim. This means you may be able to recover money spent or lost on things like medical bills, lost wages, physical disability, emotional suffering, disfigurement, or other pain experienced due to the injury.

What must you show to prevail in your case? You must be able to prove the property owner's negligence contributed to or caused the injury. Examples of injuries include animal attacks or dog bites, slip-and-fall accidents, and exposure to harmful or toxic substances like mold or lead. You must also be able to show that the owner neglected to maintain his or her property or else created the dangerous condition that caused the harm, that the owner knew the hazard existed but didn't tell visitors or tenants, that the owner did not repair or remove a condition that might have attracted children, or that the owner caused damage to a neighbor's property by doing or failing to do something.
